Terms and Conditions

This service may allow you to schedule an event(s) at a Rocky Rococo Restaurant. You must submit accurate information and your event must be appropriate for a family-friendly environment.

FUNdraising event requests are not guaranteed unless submitting organization (if accepted, “Organization”) receives a confirmation email from Rocky Rococo Restaurants or a participating franchisee of Rocky Rococo Restaurants accepting the request. If the FUNdraising event is approved, the date and time approved (the “Event”) will be referenced in the approval email, and the following terms and conditions apply: If the approved location for your Event is a franchisee restaurant, you will deal directly with the participating franchisee for the approved restaurant location for all aspects of the Event.

All scheduled events are subject to cancellation by Rocky Rococo Restaurants and/or its participating franchisee for the approved restaurant location, at their discretion.

DINE FOR DOUGH EVENTS: You will be provided with one electronic version of the Event fundraising flyer (the "Flyer") to the Organization for copying and distribution by the Organization as described below. The Flyer artwork, excluding the organization name and logo, is owned by Rocky Rococo Restaurants or its affiliates and may be used by Organization only as described in these terms and conditions;

Rocky Rococo or its participating franchisee for the approved restaurant location, as applicable, will donate to the Organization a percentage of net food and beverage sales (gross sales less taxes, tips, delivery and other like fees, discounts, and other typical overhead expenses) during the Event for sales where a Flyer is presented at the time of purchase as hereinafter described. A minimum of 20 Flyers must be redeemed to guarantee a donation. Purchase of Rocky Rococo® Gift Cards, delivery and retail item purchases do not count toward the net food and beverage sales for the Event.

Rocky Rococo or its participating franchisee for the approved restaurant location, as applicable, will mail a check to Organization for the total donation amount approximately 45 days following Event.

In connection with the Event, the Organization may use the name and logo of Rocky Rococo and/or its participating franchisee for the approved restaurant location, as applicable, only to promote and otherwise factually describe the Event; provided, however, that the Organization may not issue a press release to local media promoting the Event, without Rocky Rococo's prior written approval.

The Organization will make copies of the Flyer at its own expense. All other advertising costs related to the Event incurred by the Organization are also the responsibility of the Organization.

The Organization has the right, but not the obligation to: At its own expense, send Flyers to all supporters in the Organization’s database, post to Organization’s website, distribute to the Organization’s employees, friends, families and members of the community to promote the Event. By participating in the Event and using the Flyer, Organization warrants and represents that distributing the Flyers as described in the prior sentence is not in violation of any terms of use, Organization policies or any other limitations on contact previously identified to such parties or in violation of any applicable law (including without limitation online solicitation laws and the CAN-SPAM Act and/or CASL, as applicable) and Organization agrees to indemnify, defend and hold harmless Rocky Rococo Restaurants, its parent, affiliates and franchisees, and each of their respective directors, officers and employees from and against any claims by any such parties related to any such contact.
